Property Listing Agreement

The User affirms that they are the legal owner, authorized agent, or otherwise have the right to list the property on the Platform. The User grants Victorian Condominiums the right to publish the listing and display the property on the Platform and related services.

The User agrees to provide accurate, truthful and complete information for each listing. Listings must include at a minimum:

• The User agrees to pay all applicable fees associated with listing a property on this Platform. The Platform may charge a one-time listing fee or recurring fees for maintaining an active listing. The fees will be clearly communicated at the time of listing.
• Payments for listing fees shall be made through the Platform's designated payment method. Payment is due upon submission of the listing and as such, any listing not paid for is deemed not submitted.

• A property listing will remain active for a period of Thirty (30) days unless otherwise terminated by the User. The User may request a renewal of the listing for an additional fee which shall be determined by the platform.
• The User may deactivate or remove the listing at any time through their account on the Platform.
• The Platform reserves the right to remove any listing that violates this Agreement, applicable laws or the Platform's policies, at its sole discretion.

The user agrees to:

• Ensure that all information in the listing is accurate and up-to-date.
• Respond promptly to inquiries from potential buyers, tenants or agents.
• Cooperate with the Platform in resolving any disputes including providing requested documentation when necessary.
• Notify the Platform immediately if the property is sold, rented or otherwise no longer available for listing.

By submitting a listing, the User grants the Platform an unrestricted access to use, display, modify, distribute and promote the listing including all photos, videos and other media content provided by the User on the Platform and related services.

The User affirms that they have all necessary rights and permission to use and share the content provided and that such content does not infringe upon the intellectual property rights of any third party.

The Platform does not guarantee that the User's property will be sold, rented or leased through the use of the Platform. The success of any listing is dependent on a variety of factors including but not limited to market conditions, property demand and pricing.

The Platform will handle the User's personal information in accordance with its Privacy Policy. By submitting a listing, the User agrees to the collection, processing and storage of their personal data as described in the Privacy Policy.

The User agrees to indemnify the Platform from any and all claims, damages, liabilities, costs, and expenses (including legal fees) arising from;

The User affirms that the Platform shall not be liable for any indirect, incidental, special, consequential or punitive damages or for any loss of profits, data or goodwill arising from;

• The usage of the Platform or reliance on the listings
• Errors, omissions, or inaccuracies in listings
• Any interactions or transactions between the User and other users of the Platform

Victorian Condominiums shall not be held liable for any failure or delay in the performance of this Agreement due to a Force Majeure Event.

In the event of a dispute, the parties agree to first attempt to resolve the matter through Negotiation. If the dispute cannot be resolved informally, it shall be resolved in accordance with the Arbitration and Mediation Act (2023).

This Agreement shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.

The Platform reserves the right to amend or modify this Agreement at any time. Any changes will be posted on the Platform and such changes will take effect immediately upon posting. It is the User's responsibility to review this Agreement regularly for updates.

This Agreement constitutes the entire understanding between the parties regarding property listings on the Platform and supersedes all prior or contemporaneous agreements, representations, or understandings, whether written or oral relating to the subject matter hereof.

If any provision of this Agreement is found to be invalid, illegal or unenforceable, the remaining provisions shall remain in full force and effect.

No waiver of any provision of this Agreement shall be deemed a further or continuing waiver of such provision or any other provision.

The User shall not assign or transfer their rights or obligations under this Agreement without the prior written consent of the Platform. The Platform may assign or transfer its rights and obligations to any third party without notice.
